Terms and conditions
The agreement between you and MeritCount when you use the service.
1. The service
MeritCount Pvt Ltd ("MeritCount") provides online quizzes and exams through meritcount.com and exams.meritcount.com (the "service"). By creating an account or using the service you agree to these terms and to the privacy policy and proctoring and data policy, which form part of them. If you use the service on behalf of a school or institution, you confirm you are authorised to bind it.
2. Accounts
- Teachers need an account and must be at least 18. You are responsible for keeping your password private and for activity under your account.
- Student accounts are created only by a teacher, by email invitation or by a login the teacher hands out. A student joining an open quiz with a code does not need an account.
- A school may issue a sign-up code. Accounts created with it belong to that school’s workspace.
3. Your responsibilities as a teacher or school
- Tell students, and where required parents or guardians, that MeritCount is used and which checks a paper turns on, and obtain any consent your law requires before adding a student or running a paper with checks.
- Treat flags as a record to be interpreted by you, not as an automatic finding against a student.
- Enter student data accurately, keep logins you hand out safe, and remove students who leave.
- Use the scoreboard and room chat appropriately for the age of the class.
4. Acceptable use
You may not use the service to monitor anyone outside a paper, to collect data for purposes other than assessment, to attempt to access other users' data, to upload material you have no right to use, to interfere with the service, or for anything unlawful. We may suspend accounts that do.
5. Content and AI
Papers, questions, library files and other material you create remain yours; you give MeritCount permission to store and display them as needed to run the service. AI-drafted questions and AI-suggested marks are suggestions; you are responsible for reviewing them before use, and nothing AI produces is a decision of MeritCount.
6. Plans, payment and cancellation
- The free plan allows 30 new papers in any rolling twelve months, with the features shown on the pricing page. We may change those limits with at least 60 days' notice to existing accounts.
- Pro is $15 per month, billed monthly in advance in US dollars. You may cancel at any time; the plan runs to the end of the paid period and the account then returns to the free plan. Fees are non-refundable except where the law says otherwise.
- Prices may change with at least 30 days' notice; changes apply from your next billing period.
7. Availability and support
We aim to keep the service available at all times but cannot guarantee it. Planned maintenance is announced in advance where possible. Support is by email. If an outage affects a scheduled paper, tell us and we will help you re-run it and preserve any answers already saved.
8. Data and privacy
How we handle data is described in the privacy policy and the proctoring and data policy. Where you are the controller of student data, section 20 of the privacy policy sets out our commitments as your processor, and a signed data processing agreement is available on request.
9. Disclaimers and liability
The service is provided as is. MeritCount does not guarantee that checks will detect every instance of misconduct, or that any assessment result is correct; marking decisions and the interpretation of flags are yours. To the extent the law allows, MeritCount is not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid in the twelve months before the claim, or $100 if you paid none. Nothing in these terms limits liability that cannot be limited by law.
10. Termination
You can close your account at any time from the app or by emailing us. We may suspend or close accounts that break these terms, after notice where practical. On closure, data is deleted as described in the privacy policy; download what you need first.
11. Changes to these terms
We may update these terms. Material changes will be emailed to account holders at least 14 days before they take effect. Continued use after that date means you accept them.
12. Governing law
These terms are governed by the laws of India. Disputes will be handled by the courts of Jammu and Kashmir, India, unless the law requires otherwise. Consumers in other countries keep the protection of their local law.
